Schools should not be able to search student's lockers without a probable cause.

Persuasive Speech: Locker Searches
I do not think that schools should be able to search student’s lockers anytime they want without a probable cause. Some of the main reasons I believe this is because it is against the Constitution, personal embarrassment and the fact that students do not keep everything in their lockers. There are many reasons teachers would want to search the lockers, like guns or other types of contraband, but these kinds of items should be stopped from coming into the school in the first place.
One major reason teachers shouldn’t be able to look through student’s lockers is because, without suspicion or a good reason for searching, it is illegal. The 4th Amendment in the Constitution states, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Basically it is saying that a person’s property is protected from arbitrary, or random, searches and seizures. If a teacher does in fact disobey this law and goes through the child’s personal belongings, they can be sued.
The second reason I believe student’s lockers should be kept personal is because of sheer embarrassment. Many items in lockers are not illegal, but simply embarrassing to the student. They may have items such as love letters, medicine or pornography that can give a negative influence on the way they are looked at or treated. It has also been said that some teachers upon finding these items, use them purposely to inflict embarrassment on a student they may not like.
The last reason I believe lockers should be kept private is because it is not exactly a probable location to find items like guns or drugs. If “random” locker searches are common, the kids will most likely find another place to hide any type of contraband they bring. Now, with suspicion of their being a firearm in someone‘s possession, they should go and check to possibly prevent a school shooting, but these items should be stopped from getting into the school all together. The school could set up metal detectors to locate and guns or knives the student is carrying. If the school has a history of students bringing drugs to school, then they should try to set up a system of searching the children personally before coming into school.
Schools should not be able to randomly search student’s lockers. The only reason a lockers should be examined is with a strong suspicion of illegal items. Random searches of lockers are illegal, possibly embarrassing, and most likely not even a probably place to search for such items.
